By using Fair Closing Check, you agree to these terms. Please read them — they're written in plain English.

Fair Closing Check provides informational analysis only. Nothing on this site or in your analysis report constitutes legal advice, financial advice, tax advice, or mortgage counseling. Fair Closing Check is not a law firm, financial advisor, mortgage broker, or licensed housing counselor.
Before making any decisions about your mortgage or closing costs, consult a licensed real estate attorney, CPA, mortgage professional, or a HUD-approved housing counselor (free service).
1. Service Description
Fair Closing Check is an automated closing cost audit tool that analyzes Closing Disclosure documents — the federal form lenders are required to provide before mortgage closings — and identifies fees that may be inflated, questionable, or negotiable based on publicly available benchmarks and federal regulations (RESPA, TRID).
Analysis is generated using automated software and artificial intelligence. Results are produced algorithmically and have not been reviewed by a licensed professional.
The service produces an informational report including: a fee-by-fee analysis, an interest rate assessment, an escrow cushion check, suggested pushback language, and a draft negotiation email. These outputs are starting points for your own review — not final determinations.
2. Accuracy and Limitations
The analysis is based on general fee benchmarks and federal regulatory guidelines. It may not reflect:
- Your specific geographic market or local fee norms
- Your specific loan type, loan size, or lender relationship
- Recent changes in interest rates or market conditions
- Lender-specific rate sheets or discount points paid
- Fees that are legitimately higher due to your transaction circumstances
- State-specific regulations that may affect fee validity
A fee flagged by Fair Closing Check may be entirely valid in your situation. A fee not flagged may still be worth questioning. The analysis is a tool to inform your conversation with your lender, not a definitive audit.
3. User Responsibility
You must be at least 18 years old to use this service.
You are solely responsible for verifying the information in your analysis report and making your own decisions about your mortgage transaction. Fair Closing Check provides analysis; you make the decisions. Do not use this service as a substitute for professional advice tailored to your specific situation.
By using this service, you represent that you have the right to upload the document you submit (i.e., it is your own Closing Disclosure or you are authorized to act on behalf of the borrower).
4. Document Privacy and Data Handling
Documents you upload are used solely to generate your analysis report. We do not sell, share, or retain your uploaded Closing Disclosure beyond what is necessary to deliver your report. Uploaded documents are deleted from our servers promptly after your report is generated.
Before analysis, your document is automatically processed to remove personally identifiable information — including names, addresses, and Social Security numbers. Only anonymized fee data is transmitted for AI processing.
We do not use your document data for training AI models or any secondary purpose. We do not store your payment card details — payment processing is handled entirely by Lemon Squeezy.
5. Payment Terms
Fair Closing Check charges a one-time fee per analysis report. Current pricing is available at fairpricecheck.com. There are no subscriptions, recurring charges, or hidden fees.
Payments are processed by Lemon Squeezy. By completing a purchase, you also agree to Lemon Squeezy's Buyer Terms and Conditions, available at lemonsqueezy.com/buyer-terms.
6. Refund Policy
Because Fair Closing Check delivers a digital analysis report immediately upon payment, refunds are not available once your analysis has been successfully generated and delivered to your browser.
If a technical failure on our end prevents your analysis from being delivered after payment — for example, a server error that produces no result — you are entitled to a full refund. Contact us at admin@fairpricecheck.com with your Lemon Squeezy order ID and a description of the issue. We will respond within 2 business days and issue a refund if warranted.
We do not issue refunds on the basis of disagreement with the analysis results, inability to negotiate fees with your lender, or dissatisfaction with outcomes outside our control.
Note: As payment processor and Merchant of Record, Lemon Squeezy may independently issue refunds at their discretion in accordance with their own policies.
7. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR COMPLETE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEECHMARK LLC AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR FINANCIAL LOSS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ANALYSIS REPORT GIVING RISE TO THE CLAIM.
Nothing in this section is intended to limit any rights or remedies available to consumers under applicable state consumer protection laws that cannot be waived by contract, including the Virginia Consumer Protection Act.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Beechmark LLC is organized under the laws of Virginia.
10. Dispute Resolution
We prefer to resolve disputes informally. If you have a concern, email us first at admin@fairpricecheck.com and we will make a good-faith effort to resolve it within 14 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. Proceedings shall be conducted remotely via videoconference, or in Virginia at either party's election. Each party shall bear its own costs. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
You agree that any dispute will be resolved on an individual basis and not as part of a class action or representative proceeding.
11. Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date at the top of this page when we do. Continued use of the service after changes constitutes your acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify users.
12. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
