What the transfer tax covers
Transfer taxes (also called deed stamps, documentary stamps, or excise taxes) are taxes imposed by state, county, or city governments when real property changes hands. The tax is typically calculated as a rate per thousand dollars of the sale price. Transfer taxes appear in Section E of your Closing Disclosure.
Transfer tax rules vary enormously by state. About 13 states impose no transfer tax at all (including Texas, Indiana, and Wyoming). Others charge modest rates ($1 to $3 per thousand). A few states and cities have very high rates — New York City's combined transfer taxes can exceed 2% of the sale price.

Is the transfer tax negotiable in Delaware?
Transfer taxes in Delaware are set by law and non-negotiable. They are customarily paid by the split. Who pays can be renegotiated in the purchase contract.

Delaware realty transfer tax (30 Del. C. Chapter 54): State 2.5% + county 1.5% = 4.0% combined. Split equally — buyer pays 2%, seller pays 2% (each pays half of 4%). First-time homebuyer (FTHB) exemption on state portion only: FTHB pays 0% state transfer tax on first $400,000 of consideration (state portion capped, eff. August 1, 2017); FTHB still pays 0.75% county rate (half of 1.5% county). All three counties (New Castle, Kent, Sussex) impose 1.5% county rate. Delaware's combined 4.0% rate is among the highest in the nation and the primary driver of high closing costs. Grantor bears the burden absent agreement; by custom split 50/50. FTHB exemption reduces state portion (2.5%) on first $400K — saving up to ~$5,000 for a FTHB on a $375K purchase. Both New Castle County and Kent County confirmed at 1.5% county rate. Sussex County also 1.5%. State rate is 2.5% because local levy is ≥ 1.5% (if local were < 1.5%, state rate would be 3.0%).
